1. Service Description

NetWatchly ("we", "us", or "our") is an HTTP/HTTPS uptime monitoring service that periodically checks user-configured URLs and sends availability alerts.

The service is provided for informational and monitoring purposes only and does not guarantee uninterrupted operation or error-free results.

2. Eligibility

You must be at least 16 years old or the minimum legal age required in your jurisdiction to use online services.

3. Accounts

To use NetWatchly, you must provide a valid email address.

You are responsible for maintaining the security of your account and access to your email.

You may delete your account at any time. Upon deletion, associated data will be removed in accordance with our Privacy Policy, except where retention is required for security or legal obligations.

Accounts that remain inactive for more than one month may be suspended, limited, or removed to help maintain service availability and manage hosting resources.

4. Acceptable Use

You agree to use NetWatchly only for lawful purposes and in compliance with applicable laws.

You may only monitor URLs that you own or are explicitly authorized to monitor.

You must not:

• attempt to probe, scan, or attack third-party systems without permission
• overload, disrupt, or abuse the service, including excessive requests, automated misuse, or behavior that negatively impacts system stability
• reverse engineer, decompile, or interfere with the platform
• use the service in violation of any applicable law or regulation

We reserve the right to take action against misuse, including suspension or termination of access, at our sole discretion.

5. Service Availability

NetWatchly is provided on a best-effort basis.

We do not provide uptime guarantees or service-level agreements (SLAs).

We are not responsible for:

• downtime of the service
• delays or failures in alert delivery
• inaccuracies in monitoring results caused by external systems, networks, or third-party dependencies

Service interruptions, maintenance, or changes may occur at any time without notice.

6. Data and Privacy

Your use of NetWatchly is also governed by our Privacy Policy, which describes how we collect and process data.

We recommend reviewing it to understand what data we store and how it is used.

7. Donations

NetWatchly is free to use.

Optional donations may be made via third-party platforms such as Ko-fi. Donations are voluntary and do not grant additional rights, features, or guarantees.

8. Intellectual Property

All rights to the NetWatchly platform, including software, design, branding, and related intellectual property, belong to us or our licensors.

You retain ownership of all data you submit, including monitored URLs, configuration settings, and monitoring results.

9. Termination

We may suspend or terminate access to the service if:

• you violate these Terms
• you misuse or abuse the system
• your usage poses a risk to the service, infrastructure, or other users

You may stop using the service and delete your account at any time.

We may also discontinue the service, in whole or in part, at any time.

10. Indemnification

You agree to indemnify, defend, and hold harmless NetWatchly from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to:

• your misuse of the service
• your violation of these Terms
• your violation of any applicable law or third-party rights

11. Limitation of Liability

To the maximum extent permitted by law, NetWatchly is provided "as is" and "as available".

We are not liable for any damages, including but not limited to:

• missed or delayed alerts
• data loss
• downtime or service interruptions
• indirect, incidental, or consequential damages

In no event shall our total liability exceed the amount paid by you (if any) for use of the service in the preceding 12 months.

Your use of the service is at your own risk.

12. Force Majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to:

• network failures
• third-party service outages
• natural disasters
• acts of government

13. Changes to the Service or Terms

We may update these Terms from time to time.

If changes are material, we will make reasonable efforts to notify users.

Continued use of the service after changes means acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Serbia, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms shall be resolved before the competent courts in Serbia.
